Service Agreements
These Terms of Service apply together with any proposal, quote or separate written agreement we provide. If there is any inconsistency between these Terms of Service and a signed agreement, the signed agreement will take precedence to the extent of the inconsistency.
Quotes and Estimates
All quotes and estimates are based on the information available at the time of issue and are generally valid for 30 days unless otherwise specified in writing. Pricing may need to be updated where site conditions, scope of work or regulatory requirements differ from what was initially disclosed.
Payment Terms
- Payment terms are specified in individual service agreements
- Payment is due within the timeframe specified in your invoice
- Late payments may incur interest charges as permitted by law
- We reserve the right to suspend services for non-payment
Cancellation Policy
You may cancel or reschedule a booking by providing reasonable notice (at least 24 hours for standard service visits, or as specified in your service agreement for larger projects). We may charge a reasonable cancellation or mobilisation fee where work has already commenced, materials have been ordered, or our technicians attend site and cannot gain access.
Client Responsibilities
As a client, you agree to:
- Provide accurate information about your fire protection needs
- Ensure safe access to work areas
- Obtain necessary permits and approvals
- Notify us of any site-specific hazards or requirements
- Maintain systems as recommended after installation
Emergency Services and Response
EmberGuard Fire Protection is not an emergency service provider. While we may offer after-hours or urgent support, response times are not guaranteed and may be affected by technician availability, location, safety considerations and other factors outside our control. In an emergency you should always contact 000 and follow the directions of emergency services.
Limitation of Liability
While we strive to provide the highest quality service, EmberGuard Fire Protection is not liable for:
- Incidental or consequential damages
- Issues arising from client failure to maintain systems
- Damages resulting from third-party interference
- Losses exceeding the value of services provided
Warranty and Guarantees
We stand behind our workmanship and materials. Specific warranty terms are provided in writing for each service. Warranty claims must be made promptly upon discovery of any defects.
Compliance and Regulations
All services are performed in accordance with relevant Australian standards and regulations, including:
- Relevant Australian Standards (including, where applicable, AS 1851 – Routine service of fire protection systems and equipment)
- National Construction Code / Building Code of Australia
- Applicable state and local fire safety legislation, regulations and guidelines
